What we do
TCPA
Telephone Consumer Protection Act
Your phone should not be an open door for companies that never asked permission. The TCPA puts limits on automated calls and texts, and gives you the right to hold violators accountable.
Speak to an Attorney →What the law covers
Congress passed the TCPA in response to a flood of consumer complaints about robocalls and unwanted texts. It restricts calls and messages placed with autodialing technology or prerecorded and artificial voices, especially to cell phones.
In many situations a business needs your prior express consent, and for marketing it needs your prior express written consent, before it can reach you this way.
What an autodialer is
An autodialer is software that places calls or sends texts in bulk with little or no human involvement. If you hear a pause before someone picks up, get a prerecorded message, or receive the same text many others received, automation may be involved.
What you may recover
The TCPA provides statutory damages of $500 for each unlawful call or text, and up to $1,500 for each one made willfully or knowingly. Repeated calls can add up quickly. Results depend on the facts of each case.
